EligibilityMadGame.com "College Football's Craziest Fan Contest ("the Contest") is open only to individuals who are legal residents of the fifty (50) United States or the District of Columbia, and who are 18 years of age or older at the time of the contest. Employees, contractors, directors and officers of MadGame.com and 180s (collectively recognized as "the Sponsor"), their respective parents, subsidiaries and affiliated companies, distributors, web design, marketing, advertising, fulfillment, judging and Contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, "Contest Parties"), and the immediate family members (spouse, parent, child, sibling and spouse or "step" of each) and those living in the same households (those persons whether related or not who live in the same residence for at least three months during the twelve month period preceding the start date of the Contest) of each such employee, contractor, director or officer are not eligible to participate. Contest JudgingWinner is subject to verification, including without limitation, verification of eligibility and compliance with these Official Rules. If attempted notification is returned as undeliverable, if winner cannot be verified, or if a winner is otherwise unable to accept a Prize, the Prize will be forfeited. Entrants agree that the Sponsors have the sole right to decide all matters and disputes arising from this Contest and that all decisions of Sponsors are final and binding. The person whose name appears on the Account will be deemed the Entrant. The Entrant is the one (1) person who is the authorized account holder of the Account and the email address associated with that Account. In the event of dispute regarding the identity of the holder of an Account, dispute will be resolved in favor of the individual who is both the authorized holder of the Account and password associated with the Account (based upon information submitted at the time the Account was created or updated upon registration for this Contest) and, if available, the "authorized e-mail account holder" of the provided e-mail address when the Account was created. "Authorized email account holder" is defined as the natural person assigned an e-mail address by an Internet access provider, online service provider, or other organization (i.e., business, education institution) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. General ConditionsBy entering this Contest, and to the extent allowed by law, entrants grant MadGame.com and each of their affiliates, licensees, promotional partners, and third party marketing entities the absolute right and permission to use the name, picture, voice, biographical data, photograph, testimonial, or other likeness and/or prize information or personal exposition (and/or any edited portion thereof), and/or any information contained in a Video Submission or entry, and to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, exploit, and use the content of and elements embodied in the Video Submissions, entries, and the entries themselves, in perpetuity in any and all media, including but not limited to digital and electronic media, computer, audio and audiovisual media (whether now existing or hereafter devised), in any language, throughout the world, and in any manner, for trade, advertising, promotional, commercial or any other purposes without further review, notice, approval, consideration, or compensation to the entrant. Participation in the Contest constitutes entrant?s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding, and a representation that the entrant is eligible to participate in this contest. Release and Limitations of LiabilityBy participating in the Contest, entrants agree to release, indemnify, and hold harmless the Contest Parties from and against any claim, loss, liability, damage, or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, a Contest Party?s liability will be limited solely to the cost of entering and participating in the Contest, and in no event shall any Contest Party be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. DisputesExcept where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Arizona. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules (whether of the State of Arizona or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Arizona.
